Please read these Terms of Service ("Terms") carefully before using framesforvenezuela (the "Site") operated by Joana Roscheck ("we," "us," or "our").

1. Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

3. Products

We sell fine-art photographic prints. Product images shown on the Site are for illustration purposes; actual colours may vary slightly depending on your screen settings and the printing process.

All prints are produced on demand by our print fulfilment partner and shipped directly to you. Because prints are produced to order, please allow the stated production and shipping times shown at checkout.

4. Donation Model

100% of the profit from sales made through this Site is donated to Caritas Austria's Venezuela earthquake relief fund. This is a voluntary commercial commitment on our part; your purchase itself is a standard sale of goods and does not constitute a tax-deductible donation on your part.

5. Pricing and Payment

All prices are listed in EUR and include applicable taxes unless stated otherwise. As we operate under the Austrian small business exemption (Kleinunternehmerregelung, § 6 Abs. 1 Z 27 UStG), no VAT is shown separately on invoices.

Payment is processed securely through Shopify Payments. We do not store your full payment card details.

6. Shipping

We offer shipping to European Union. Estimated delivery times are provided by our fulfilment partner and are not guaranteed; delays may occasionally occur due to production or customs processes.

7. Right of Withdrawal (Widerrufsrecht)

As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us at byjoanavictoria@gmail.com of your decision to withdraw from this contract by an unequivocal statement (e.g. an e-mail).

Effects of withdrawal: If you withdraw from this contract, we shall reimburse the price paid and the standard delivery cost, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall bear the direct cost of returning the goods unless we have agreed otherwise. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

8. Warranty and Damaged Items

If your print arrives damaged or defective, please contact us within 14 days of delivery at [your email] with a photo of the issue. We will arrange a free replacement print at no cost to you. This is separate from, and in addition to, your statutory right of withdrawal above.

9. Intellectual Property

All photographs, designs, and content on this Site are the property of Joana Roscheck unless otherwise stated, and are protected by copyright. You may not reproduce, distribute, or use these images for commercial purposes without our prior written consent.

10. Limitation of Liability

To the extent permitted by applicable law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of our products. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Austrian or EU consumer protection law.

11. Dispute Resolution

You have the right to submit complaints to the EU's Online Dispute Resolution platform: http://ec.europa.eu/consumers/odr/. We are not obliged to, and do not, participate in dispute resolution proceedings before a consumer arbitration board.

12. Governing Law

These Terms are governed by Austrian law, without regard to its conflict of law provisions. This does not deprive you, as a consumer, of the protection afforded to you by mandatory provisions of the law of the country in which you have your habitual residence.
